WatchDeck Terms of Service

Last updated October 22, 2026.

These Terms are an agreement between you and Software Enabled Logistics LLC, a Delaware limited liability company operating WatchDeck (“WatchDeck,” “we,” “us,” or “our”). Our registered office is 131 Continental Drive, Suite 305, Newark, DE 19713, United States. Customer-support and legal inquiries should be sent to admin@trywatchdeck.com. By creating an account, purchasing a subscription, or using the service, you agree to these Terms and acknowledge the Privacy Policy. If you use WatchDeck for an organization, you represent that you have authority to bind it.

Important vessel-safety notice. WatchDeck is an organizational and recordkeeping aid. It is not a navigation system, emergency-response service, inspection, survey, class or flag-state system, or substitute for manufacturer instructions, professional judgment, seamanship, required physical documents, or legal and regulatory compliance. Never rely on WatchDeck as the only source for a safety-critical decision.

1. Eligibility and accounts

You must be at least 18 and legally able to enter this agreement. Provide accurate information, protect your credentials, and promptly notify us of suspected unauthorized access. You are responsible for activity under your account and for deciding who may access each vessel workspace. A vessel owner or workspace administrator is responsible for obtaining appropriate authorization before adding crew, contacts, vendors, signatures, locations, or other people’s information.

2. License and acceptable use

Subject to these Terms and payment of applicable fees, WatchDeck grants you a limited, revocable, nonexclusive, nontransferable right to use the service for your personal or internal business operations. You may not misuse the service, interfere with security, probe or access accounts without authorization, introduce malicious code, scrape or reverse engineer the service except where law expressly permits, resell access without permission, violate another person’s rights, or use WatchDeck unlawfully.

3. Your content and permissions

You retain ownership of records and files you submit. You grant WatchDeck and its service providers a worldwide, limited license to host, copy, transmit, transform, and otherwise process that content only as needed to operate, secure, support, and improve the service and fulfill your requests. You represent that you have the rights and permissions needed to submit the content, including manuals, photos, invoices, contact information, and records concerning crew or vendors.

Collaboration features disclose records to people you invite. Review access carefully. Removing access does not retrieve copies someone previously exported or lawfully received.

4. AI-assisted features

When you request AI-assisted manual review, selected manuals and equipment details are processed by an AI service to draft maintenance items. AI output may be incomplete, outdated, or wrong. You must review every suggested task, interval, part number, procedure, and quotation against the current manual for the exact equipment and consult a qualified marine professional when appropriate. Do not use AI output as authorization to perform work or operate a vessel.

5. Operational responsibility

You remain solely responsible for vessel condition, inspection, maintenance, navigation, departure decisions, crew competence, safety equipment, emergency procedures, documentation, and compliance. Reminders can be delayed, suppressed, misconfigured, or unavailable. Location and trip data can be inaccurate or incomplete. A checklist marked complete does not establish seaworthiness or compliance. Maintain required independent records, alarms, inspections, manuals, backups, and emergency resources.

6. Subscriptions, renewal, cancellation, and refunds

Prices and billing intervals are shown before purchase. Unless stated otherwise, paid subscriptions renew automatically for the selected monthly or annual period until canceled. You authorize the applicable payment provider to charge each renewal. Cancel before the renewal date through the WatchDeck billing portal or, for an App Store purchase, Apple’s subscription settings. Cancellation stops future renewal and normally leaves paid access active through the current period.

Except where law requires otherwise or the purchase screen states differently, fees are nonrefundable and we do not provide prorated refunds for unused time. Apple processes and determines refunds for App Store purchases under Apple’s policies. Taxes may be added where required. We will provide advance notice of material price changes where required by law.

7. Service changes, suspension, and termination

We may improve, modify, suspend, or discontinue features. We may suspend or terminate access for nonpayment, security risk, unlawful conduct, material breach, or risk to users or the service. You may stop using WatchDeck and delete your account. Export important records before termination. Provisions that by their nature should survive—including ownership, disclaimers, liability limits, and dispute terms—will survive.

8. Third-party services

WatchDeck relies on third-party hosting, authentication, payment, app-store, mapping, analytics, and AI services. Their availability and separate terms may affect features. Links or integrations do not constitute a warranty or endorsement of third-party information.

9. Intellectual property and feedback

WatchDeck, its design, software, branding, and documentation are owned by WatchDeck or its licensors and protected by law. These Terms do not transfer those rights. If you submit feedback, you permit us to use it without restriction or compensation, without identifying you publicly unless separately agreed.

10. Disclaimers

To the fullest extent permitted by law, WatchDeck is provided “as is” and “as available.” We disclaim all express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, noninfringement, accuracy, availability, security, and that the service will prevent failures, downtime, injury, loss, regulatory violations, or missed maintenance. No oral or written information creates a warranty not expressly stated here.

11. Limitation of liability

To the fullest extent permitted by law, WatchDeck and its suppliers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; loss of profits, revenue, use, goodwill, or data; vessel downtime; loss of charter or work; substitute services; property damage; personal injury arising from reliance on records, reminders, checklists, or AI output; or unauthorized access caused by credentials or sharing under your control.

To the fullest extent permitted by law, the aggregate liability of WatchDeck and its suppliers for all claims arising from or relating to the service will not exceed the greater of US $100 or the amount you paid WatchDeck for the service during the 12 months before the event giving rise to the claim.

Some jurisdictions do not allow certain exclusions or limits. In those jurisdictions, these provisions apply only to the maximum extent permitted and do not exclude rights that cannot lawfully be waived.

12. Indemnity for organizational use

If you use WatchDeck for a business or organization, you will defend and indemnify WatchDeck from third-party claims arising from your content, your vessel operations, your violation of law or another person’s rights, or access you grant, except to the extent caused by WatchDeck’s own unlawful conduct. This section applies only where permitted by law.

13. Disputes and applicable law

Before filing a claim, contact admin@trywatchdeck.com and allow 30 days for an informal resolution. These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules, except that mandatory consumer protections in your home jurisdiction remain applicable. Courts with lawful jurisdiction may hear unresolved disputes. Nothing prevents either party from seeking urgent injunctive relief or using an eligible small-claims process.

14. General

These Terms, the Privacy Policy, the Cookie Notice, and purchase disclosures are the agreement concerning the service. If one provision is unenforceable, the remainder continues. Failure to enforce a provision is not a waiver. You may not assign these Terms without consent; we may assign them as part of a reorganization, financing, merger, sale, or transfer of the service. Neither party is liable for delay caused by events beyond reasonable control, except payment obligations.

15. Changes and contact

We may update these Terms. We will post the revised date and provide additional notice when legally required. Continuing to use the service after an effective update constitutes acceptance where permitted; if you do not agree, stop using the service and cancel before the next renewal. Questions may be sent to admin@trywatchdeck.com.
